TDIU: How to Get 100% VA Pay at a Lower Disability Rating

Total Disability Individual Unemployability (TDIU) lets veterans receive 100% compensation even if their combined rating is less than 100%. Here is how it works.

What Is TDIU?

Total Disability Individual Unemployability (TDIU) is a VA benefit that pays veterans at the 100% disability rate even when their combined disability rating is less than 100%. It is designed for veterans whose service-connected disabilities prevent them from holding substantially gainful employment.

In 2026, the 100% VA disability rate is $3,938.58 per month for a single veteran with no dependents. TDIU gets you to that same payment level.

Who Qualifies for TDIU?

There are two paths to TDIU eligibility:

Schedular TDIU requires at least one service-connected disability rated at 60% or higher, OR a combined rating of 70% or higher with at least one disability rated at 40% or higher.

Extraschedular TDIU is for veterans who do not meet the schedular requirements but can still demonstrate that their service-connected disabilities prevent substantially gainful employment. This requires a referral to the VA Director of Compensation Service.

In both cases, you must show that your service-connected conditions (not age, not non-service-connected conditions) prevent you from maintaining substantially gainful employment.

What Counts as Substantially Gainful Employment?

The VA generally considers employment below the poverty threshold to be "marginal" rather than substantially gainful. In 2026, that threshold is approximately $15,960 per year for a single person. However, earning above this amount does not automatically disqualify you -- the VA considers the totality of your circumstances, including work accommodations and the nature of employment.

How to Apply

You apply for TDIU by filing VA Form 21-8940 (Veteran's Application for Increased Compensation Based on Unemployability). You will also need to have your most recent employer complete VA Form 21-4192.

Key tips for your application:

  • Be specific about how your service-connected disabilities affect your ability to work. Do not just list diagnoses. Describe functional limitations.
  • Include medical evidence that supports your inability to work. Treatment records, doctor statements, and vocational assessments strengthen your case.
  • Document your employment history and explain why you left each job or why you cannot perform those duties anymore.
  • Work with a VSO (Veterans Service Organization). They can help you prepare your application and present the strongest possible case.

TDIU vs. 100% Schedular

TDIU and 100% schedular provide the same base compensation rate. However, there are some differences in additional benefits:

  • Both 100% schedular and TDIU require a permanent and total (P&T) determination to qualify for Dependents Educational Assistance (DEA, Chapter 35)
  • A 100% rating alone, whether schedular or TDIU, does not automatically confer DEA -- the VA must also find the disability is permanent
  • Both qualify you for CHAMPVA (healthcare for dependents) and most state-level 100% disability benefits

Can You Work While on TDIU?

This is a critical question. The general rule is that you cannot maintain substantially gainful employment while receiving TDIU. However, the VA allows marginal employment and has a special program that allows veterans to work for up to 12 months without losing TDIU benefits while they test their ability to return to work.

What Benefits Does TDIU Unlock?
