How to File for a VA Disability Increase

If your service-connected conditions have gotten worse, you may be entitled to a higher rating. Here is a step-by-step guide to filing for an increase.

When Should You File for an Increase?

If your service-connected disabilities have worsened since your last VA rating decision, you have the right to file a claim for an increased rating. There is no limit to how many times you can file for an increase, and there is no penalty for doing so.

Common signs that you may be eligible for an increase include:

  • Your condition has worsened and affects your daily life more than before
  • You have new medical evidence documenting increased severity
  • You need more frequent medical treatment than when you were last rated
  • Your condition now limits your ability to work

Step 1: Gather Your Medical Evidence

The most important factor in a successful increase claim is current medical evidence. The VA will look for documentation showing that your condition has worsened. This can include:

  • Recent treatment records from VA or private doctors
  • Diagnostic test results (imaging, lab work, etc.)
  • Buddy statements from family or friends describing how your condition affects your daily life
  • A Disability Benefits Questionnaire (DBQ) completed by your doctor

Pro tip: Ask your private doctor to complete the appropriate DBQ form for your condition. These forms are available on the VA website and are specifically designed to capture the information VA raters need.

Step 2: Consider Working With a VSO

A Veterans Service Organization (VSO) representative can help you file your claim at no cost. VSOs like the DAV, VFW, American Legion, and AMVETS have accredited representatives who understand the claims process and can significantly improve your chances of success.

To find a VSO near you, visit the VA's accredited representative search tool or call your local VA regional office.

Step 3: File Your Claim

You can file a claim for increase through several channels:

  • Online at VA.gov: The fastest method. Log in to VA.gov, navigate to the disability section, and select "File for a disability compensation increase."
  • By mail: Complete VA Form 21-526EZ and mail it to your regional VA office.
  • In person: Visit your local VA regional office with your VSO.
  • Through your VSO: Your representative can file on your behalf.

When filing, select "Claim for Increase" and identify the specific conditions that have worsened.

Step 4: Attend Your C&P Exam

After filing, the VA will likely schedule a Compensation and Pension (C&P) exam. This exam is critical to your claim. Tips for your C&P exam:

  • Be honest about your worst days. Do not minimize your symptoms. Describe how your condition affects you on your worst days, not your best days.
  • Bring documentation. While the examiner should have your records, bring copies of recent medical evidence as a backup.
  • Describe functional limitations. Explain specifically how your condition limits your daily activities, work, and quality of life.
  • Do not skip the exam. A missed C&P exam will almost certainly result in a denial.

Step 5: Review Your Decision

After the VA makes a decision, review it carefully. If you disagree with the result, you have several options:

  • Supplemental Claim: Submit new evidence and ask for another review
  • Higher Level Review: Request a senior reviewer to look at the same evidence
  • Board Appeal: Appeal to the Board of Veterans Appeals

Each option has different timelines and requirements. Your VSO can help you decide which path is best.
